terms of service

effective 18 august 2026 · privacy · acceptable use

the short version

you rent a linux computer from us by the month. your coding agent runs it. what you build on it is yours.

you can cancel any time. if you cancel in your first 7 days, we refund you in full. after that, cancelling stops the next charge and your sub stays on until the period you paid for ends.

don't use it to harm other people or break the law. we keep snapshots so mistakes are cheap, but you are responsible for keeping copies of anything you can't lose.

these are the terms for using sub, at sub.computer and sub.software. by making an account you agree to them. if you don't agree, please don't use sub.

1. who we are

sub is operated by Peter Sugihara, an individual doing business as sub ("sub", "we", "us"). you can reach us at support@sub.software. when we say "you", we mean the person or organisation with the account.

2. what sub is

sub gives you a persistent cloud computer (a "sub" or "box"): a virtual linux server with root access, a public ip address, and a name under sub.computer. you operate it through a coding agent (for example claude code or codex) that connects to sub over the model context protocol (mcp), or through any other client we support. sub is infrastructure. it is not a code review, a security service, or a guarantee that whatever your agent builds will work.

3. your account

4. your stuff

everything you or your agent puts on your box, and everything you build with it, belongs to you. we claim no rights in it. you're responsible for it: for having the right to use and publish it, for keeping it lawful, and for the people who use whatever you make live.

you give us only the permission we need to run the service: to store, copy, snapshot, back up, and transmit your data so your box works, and to look at it in the narrow cases described in the privacy policy (keeping the service running, handling abuse reports, and complying with the law).

5. what your agent does is on you

your agent has root. it can install anything, run anything, and break anything on your box. you're responsible for what it does, including anything it does with third-party services, api keys, or data you give it access to. we make breaking things cheap to undo with snapshots; we don't make it impossible.

6. acceptable use

the acceptable use policy is part of these terms. in short: no spam, phishing, malware, crypto mining, attacking other systems, illegal content, or anything that puts other customers or our providers at risk. we can suspend or stop a box immediately if we reasonably believe it's being used to cause harm.

7. snapshots, backups, and losing data

your box takes snapshots so your agent can undo changes, and we may keep off-box copies for disaster recovery. we do this carefully, but it is a safety net, not a promise. hardware fails, providers have outages, and an agent with root can delete its own undo history. keep your own copies of anything you can't afford to lose. we're not liable for lost data.

8. billing

9. cancelling and refunds

10. suspending or ending your service

we can suspend or terminate your sub if you break these terms or the acceptable use policy, don't pay, or if we're required to by law or by the providers we build on. where it's reasonable we'll warn you first and give you time to fix it. for serious abuse (phishing, malware, attacks) we act first and email you after. you can end things any time by cancelling.

we may also stop offering sub entirely. if we do, we'll give you at least 30 days' notice and refund any prepaid time you don't get to use.

11. our access to your box

the sub control plane holds an ssh key for your box so it can carry out what your agent asks. we use that access to run your agent's commands, set up and maintain the box, take snapshots, and investigate problems or abuse reports. we don't browse your files out of curiosity and we don't sell or use your data for anything else. we keep an audit log of what the agent asked us to do; you can see it from your account. details are in the privacy policy.

12. availability

we aim to keep sub up all the time and to fix problems fast, but we're a small service built on third-party providers and we don't offer an uptime guarantee at this stage. we'll be honest with you about incidents.

13. things we don't promise

sub is provided "as is". to the extent the law allows, we make no warranties, express or implied, including about fitness for a particular purpose, uptime, or that your agent will build what you asked for.

14. limits on liability

to the extent the law allows, we're not liable for indirect, incidental, special, or consequential losses, or for lost profits, revenue, or data, however caused. our total liability to you for anything arising from sub is limited to the amount you paid us in the 3 months before the claim. some places don't allow these limits, so they may not fully apply to you.

15. your responsibility for claims

if someone brings a claim against us because of what you or your agent did on your box, or the content you made public, you agree to cover our reasonable costs of dealing with it.

16. changes to these terms

we may update these terms. if a change matters, we'll email you at least 14 days before it takes effect. keeping your subscription after that means you accept the new terms. the current version always lives at sub.computer/terms.

17. law and disputes

these terms are governed by the laws of california, united states, without regard to conflict-of-law rules. before starting anything formal, email us; most things can be sorted out with a conversation. anything that can't goes to the state or federal courts in san diego county, california, and you and we agree to their jurisdiction.

18. the boring bits

these terms plus the acceptable use and privacy policies are the whole agreement between us about sub. if part of them turns out unenforceable, the rest still stands. if we don't enforce something right away, we haven't given up the right to. you can't transfer your account without our okay; we can transfer these terms if sub changes hands, and we'll tell you if we do.
